Do You Need Council Consent for Solar Panels in New Zealand? Let’s Clear the Air!

Solar power is lighting up New Zealand homes more than ever, but a common question still lingers: Do I need council consent for my solar power (PV) system? The good news is, in most cases, the answer is a sunny no! 🌞

What’s the Deal with Building Consent?

Under the Building Act 2004, energy work like solar PV installations is exempt from needing building consent. Section 43 makes it clear:

Energy work does not require a building consent.

So, unless you’re planning something out of the ordinary, like replacing your roof with solar panels (more on that below), your installation can proceed hassle-free.

But Wait... Where Did All the Confusion Come From?

Back in the day (think over a decade ago), solar PV got mixed up with its plumbing cousin, solar hot water systems. It was like mistaking apples for oranges. 🍎🍊 While hot water systems needed consent for safety reasons, PV solar is an electrical system and doesn’t require the same oversight.

If your solar panels also act as your roof (rare, but possible), building consent is required. After all, you’re altering the very structure that keeps the rain out!

Heritage Zones

Live in a heritage or special interest area? Your local council might ask for resource consent to ensure your panels don’t clash with the neighbourhoods charm.

Height-to-Boundary Restrictions

If your panels exceed height restrictions or cast a neighbour-shading shadow of doom, you may need to check the rules from your local council.

Ground-Mounted Arrays

What About Roof Strength?

No need to sweat the weight of your panels—modern houses are built to handle the load with ease. Unless you live in a house of cards (or rusted-out old shed), your roof that is built to New Zealand's building code will be just fine.
